These Terms of Service ("Terms") govern the use of PlanePic (the "Service"). By using the Service, you agree to these Terms.
These Terms apply to all relationships between users and the operator of the Service in connection with the use of the Service.
The Service is not available to anyone under the age of 13. Users between the ages of 13 and 18 must have the consent of a parent or legal guardian to use the Service.
Registration for the Service is completed through email-based authentication. The operator may refuse or cancel a registration it considers inappropriate.
Users must not engage in any of the following when using the Service:
Copyright in the photos and other content you upload to the Service remains with you. You grant the operator a royalty-free license to use that content to the extent necessary to display and share it on the Service, including via share links and public lists.
If content that infringes the rights of a third party or violates public order and morals is posted, the operator may remove it (including making a public list private) without prior notice. The Service provides a way for users to report content posted by other users; the operator reviews reports received and takes appropriate action.
The Service offers a free plan and a paid plan (billed monthly or annually). For details of the paid plan's pricing and payment method, please see the disclosure under Japan's Specified Commercial Transactions Act (a mandatory disclosure for e-commerce operators in Japan). The paid plan is a subscription that automatically renews through our payment processor (Stripe), and users may cancel at any time. Cancellation takes effect from the next renewal date, and amounts already paid are not refunded on a pro-rata basis.
Users residing in the European Economic Area (EEA) may, under the EU Consumer Rights Directive, have the right to withdraw from a contract for digital content or services within 14 days of formation, without giving any reason. When subscribing to a paid plan, you agree that the Service will begin immediately upon completion of payment, and you acknowledge that you thereby lose this right of withdrawal. Subscribing to a paid plan constitutes this agreement.
The operator may suspend or interrupt all or part of the Service without prior notice to users in any of the following cases:
If a user violates any provision of these Terms, the operator may, without prior notice, restrict that user's use of all or part of the Service or cancel their registration. Users may also delete their own account at any time from the Profile page.
The operator makes no express or implied warranty that the Service is free of factual or legal defects. Except in cases of the operator's willful misconduct or gross negligence, the operator is not liable for any damages arising from the Service.
The operator may change, add to, or discontinue the content of the Service upon prior notice to users, and users agree to this.
The operator may amend these Terms without notice to users when deemed necessary. Amended Terms take effect from the time they are posted on this page.
If any provision of these Terms, or part thereof, is held invalid or unenforceable under applicable law, the remaining provisions of these Terms remain in full force and effect.
These Terms are governed by the laws of Japan. Any dispute arising in connection with the Service shall be subject to the exclusive jurisdiction of the court having jurisdiction over the operator's location.
